WHAT IS A CARELESS DRIVER?

Drivers who upset other drivers, road users or pedestrians by:
Taking insufficient care
Disregarding of others
Showing a lack of consideration
Putting others at risk
2. Legal Definition:
Both careless and the more serious dangerous driving are terms which require subjective judgment and will often depend on the facts of each individual case. Proof often rests upon the evidence of prosecution eyewitnesses.
Careless driving is driving without due care and attention and applies to driving which is considered below the standard of a reasonable, prudent and competent driver. Careless driving can result in a fine and discretionary disqualification and up to nine penalty points.
Dangerous driving means driving that falls significantly below the standard of a reasonable, prudent and competent driver or driving that is obviously dangerous. A court ruling of dangerous driving can result in a fine, up to two years imprisonment and disqualification for a year or more. Anyone disqualified for dangerous driving will need to take a re-test when their disqualification expires.
